Swan Open Studios & Artist Indoor Markets, 2026
TERMS AND CONDITIONS FOR VENUES
VENUE ELIGIBILITY

Venue must complete the Venue Registration Form (below) for Swan Open Studios by the advertised deadline

Participating artists must be over 18 years of age

Venue must be situated within the City of Swan
-
Guest artists from outside of the City of Swan boundary can participate by agreement with another artist in a Venue after consultation with, and approval from, the Ellenbrook Arts, and must in all ways present themselves as an Artist in their own right and act independently from the hosting Venue

Ellenbrook Arts reserves the right to decline any application

Ellenbrook Arts will notify Venue on the success of their application via email
INSURANCE

Venue must provide a valid Public Liability Insurance Certificate to the value of $5M to cover participation in the Swan Open Studios
VENUE
-
Venue must guarantee it will open to the public during the published opening hours as stipulated on the application form

Venue must be safe, and have obtained adequate insurance to open the Venue for public visitation
REGISTRATION FEE

Payment of the Venue Registration Fee secures participation in the Swan Open Studios. Failure to make the payment by the advertised deadline excludes artists from the event

Venue acknowledges that the registration participation fee is mandatory and is used to cover signage, printing and administration costs associated with the delivery of the Swan Open Studios event
SOCIAL MEDIA / MARKETING

Swan Open Studios 2026 will be promoted through social media, websites, printed exhibition posters and full colour booklet - see Appendix 1 below for information the Venue needs to provide for social media

Venue gives permission for this information to be utilised by Ellenbrook Arts for marketing purposes relating to the Open Studios event

Venue agrees to share Swan Open Studios information to their networks

Venue agrees to use ONLY the Swan Open Studios branding in their own promotion of the event

If the Venue does not provide marketing information by the required deadline, they will be excluded from the marketing material
COPYRIGHT
-
Artwork must be the original artwork of the artist and not contravene any copyright law
-
Artwork must be created solely by the Artist. Works must not infringe upon the copyright, moral rights or intellectual property of any other person
-
The use of AI generated content must also be disclosed
-
The Artist grants Ellenbrook Arts the right to photograph and reproduce images of entered artwork for promotional, educational and archival purposes related to the exhibition
-
Ellenbrook Arts reserved the right to exclude the Artist / Venue if any artwork is found to be non-original or in breach of these conditions, without refund
DATA COLLECTION

Venue must keep a tally of the number of visitors and report these numbers back to Ellenbrook Arts
-
Venue agrees to report on the total sum of income via sales made during or due to the event

Venue must report all sales, commissions, and opportunities that arose due to the Open Studios event, up to three months after the event closes
SURVEY / FEEDBACK

The Venue agrees to take part in a participation survey at the event’s conclusion
PERSONAL CONDUCT & INDEMNITY

Venue staff and the represented Artists are expected to conduct themselves professionally at all times and must not engage in any behaviour that could bring Ellenbrook Arts into disrepute, including but not limited to criminal activity, harassment, discrimination, offensive behaviour, defamation, or disparaging remarks about Ellenbrook Arts or its associates

Ellenbrook Arts may terminate participation immediately for such conduct, with no refund

Artists and Venues agree to indemnify Ellenbrook Arts, its staff, volunteers, and agents against any claims, losses, damages or expenses arising from their actions, omissions or participation in the exhibition

Ellenbrook Arts accepts no responsibility for loss, damage, theft or injury to persons or property
-
Artists are responsible for their own artwork and public liability insurance
ARTIST INDOOR MARKETS

Ellenbrook Arts recognises that Artists may also wish to participate in the Artists Indoor Market on Saturday 18 April, Sunday 19 April, Saturday 25 April and Sunday 26 April, to showcase their artwork and related merchandise

The Venue agrees to contact Ellenbrook Arts with details of their Artists who wish to participate; Ellenbrook Arts staff will liaise with the Artists to invite them to participate

The Artist Indoor Markets will be held at Ellenbrook Arts HQ, 34 Main Street, Ellenbrook

The artist/s will be provided with a trestle table and will be able to set up at 9am and open to the public at 10am, close to the public at 2pm and pack away by 3pm
-
Market stalls may be left set up overnight on Saturdays if the Artist has next day trading on Sunday, but Ellenbrook Art accepts no responsibility for artwork / merchandise left onsite

Artists that choose to be in the Artist Indoor Market will have their time and dates published with other marketing materials to the general public
-
The Artist will give 48 hours notice to Ellenbrook Arts if they cannot attend the Artist Indoor Markets
-
Artists must use their own POS system
