INDIVIDUAL ARTIST TERMS AND CONDITIONS 


ARTIST ELIGIBILITY

 

  • Artists must complete their registration for Swan Open Studios 2026 by 18 February, 2026.

  • Artists must be over 18 years of age.

  • Artists must reside or work within the City of Swan boundaries.

  • Artist studio must be situated within the City of Swan.

  • Artist must in all ways present themselves as an artist in their own right.

  • Ellenbrook Arts reserves the right to decline any registration.

  • Ellenbrook Arts will notify artists on the success of their registration via email.

 

INSURANCE

 

  • Artists must provide a valid Public Liability Insurance Certificate to the value of $5M to cover participation in the event.

  • If Artists require guidance or assistance in obtaining insurance through a professional arts association, Ellenbrook Arts staff can assist with this inquiry.


STUDIO

 

  • Artists guarantee their studio will be open to the public during their published opening hours as stipulated on their registration form.

  • Artists must be satisfied that their venue is safe, and have obtained adequate insurance to open their studios for public visitation.


REGISTRATION FEE

 

  • Artist acknowledges that the registration participation fee is mandatory and is used to cover signage, printing and administration costs associated with the delivery of the event.

 

SOCIAL MEDIA / MARKETING

  • The Swan Open Studios will be promoted through social media, exhibition posters and websites.

  • Artists must display the Open Studio sign.

  • See Appendix 1 at the bottom of this page for information the artists must use when posting to social media.

  • Artist gives permission for this information to be utilised by Ellenbrook Arts for marketing purposes relating to the event.

  • Artist agrees to share Swan Open Studios information to their networks.

  • Artist agrees to use ONLY the Swan Open Studios branding in their own promotion of the event.

  • If artists do not provide marketing information by the required deadline, they will be excluded from the marketing material due to publishing deadline requirements.

 

COPYRIGHT

 

  • Artwork must be the original artwork of the Artist and not contravene any copyright law.

  • Artwork must be created solely by the Artist. Works must not infringe upon the copyright, moral rights or intellectual property of any other person.

  • The use of AI generated content must be disclosed.

  • The Artist grants Ellenbrook Arts the right to photograph and reproduce images of entered artwork for promotional, educational and archival purposes related to the exhibition.

  • Ellenbrook Arts reserved the right to exclude the Artist if any artwork is found to be non-original or in breach of these conditions, without refund.

 

DATA COLLECTION

 

  • Artist must keep a tally of the number of visitors and report these numbers back to Ellenbrook Arts.

  • Artist must agree to report on the total sum of income via sales made during or due to the event.

  • Artist must report all sales, commissions, and opportunities that arose due to the event, up to three months after the event closes.

SURVEY / FEEDBACK

 

  • Artist agrees to take part in a participation survey at the event’s conclusion.

PERSONAL CONDUCT & INDEMNITY

  • Artist is expected to conduct themselves professionally at all times and must not engage in any behaviour that could bring Ellenbrook Arts into disrepute, including but not limited to criminal activity, harassment, discrimination, offensive behaviour, defamation, or disparaging remarks about Ellenbrook Arts or its associates, including through the use of social media.

  • Ellenbrook Arts may terminate participation immediately for such conduct, with no refund.

  • Artist agrees to indemnify Ellenbrook Arts, its staff, volunteers, and agents against any claims, losses, damages or expenses arising from their actions, omissions or participation in the exhibition.

  • Ellenbrook Arts accepts no responsibility for loss, damage, theft or injury to persons or property.

  • Artist is responsible for their own artwork and public liability insurance.

 

ARTIST INDOOR MARKETS

 

  • Ellenbrook Arts recognises that not all artists have a studio / space that is suitable for the general public and Artists are invited to participate in the Artist Indoor Market held at Ellenbrook Arts HQ on Saturday 18 April, Sunday 19 April, Saturday 25 April and Sunday 26 April to showcase their artwork and related merchandise.

  • Artists will be provided with a trestle table and will be able to set up at 9am and open to the public at 10am, close to the public at 2pm and depart by 3pm.

  • Market stalls may be left set up overnight on Saturdays for Sunday trading, but Ellenbrook Art accepts no responsibility for artwork / merchandise left onsite.

  • Artists that choose to be in the Artist Indoor Market will have their time and dates communicated along with other marketing materials to the general public.

  • The Artist will give 48 hours notice to Ellenbrook Arts if they cannot attend the Artist Indoor Markets.

  • Artist must use their own POS system.

  • Venue must be satisfied that the Venue is safe, and have obtained adequate insurance to open their venue for public visitation.

  • Venue acknowledges that the registration participation fee is mandatory and is used to cover signage, printing and administration costs associated with the delivery of the event.

  • A discounted entry fee and entry form is also applicable per artist. Each individual artist will also be advertised and listed individually and therefore must pay the registration fee and agree to the Artists Registered to a Venue Terms and Conditions.

  • Venue must display the Open Studio sign.

ARTIST REGISTERED TO A VENUE TERMS AND CONDITIONS 


ARTIST ELIGIBILITY

  • The link to the registration form will be provided to the Artist by the Artist's registered Venue.

  • Artists must complete their registration for Swan Open Studios 2026 by 18 February, 2026.

  • Artists must be over 18 years of age.

  • Artists must reside or work within the City of Swan boundaries.

  • Artist studio must be situated within the City of Swan.

  • Artist must in all ways present themselves as an Artist in their own right and act independently form the hosting Venue.

  • Ellenbrook Arts reserves the right to decline any registration.

  • Ellenbrook Arts will notify Artists on the success of their registration via email.

 

INSURANCE

 

  • Artists or their registered Venue must provide a valid Public Liability Insurance Certificate to the value of $5M to cover participation in the event. Please check with your registered Venue to see if they will provide this insurance.

  • If Artists require guidance or assistance in obtaining insurance through a professional arts association, Ellenbrook Arts staff can assist with this inquiry.


VENUE

 

  • Artist guarantees their Venue will be open to the public during their published opening hours as stipulated on their registration form.

  • Artists must be satisfied that the registered Venue is safe, and have obtained adequate insurance to open for public visitation, if applicable (see your registered Venue for this information).


REGISTRATION FEE

 

  • Artist acknowledges that the registration participation fee is mandatory and is used to cover signage, printing and administration costs associated with the delivery of the event.

  • A fee is applicable per artist. Artists of a registered Venue receive a discount of $25.

 

SOCIAL MEDIA / MARKETING

  • The Swan Open Studios will be promoted through social media, exhibition posters and websites.

  • Artist or their Venue must display the Open Studio sign.

  • See Appendix 1 at the bottom of this page for information the artists must use when posting to social media.

  • Artist gives permission for this information to be utilised by Ellenbrook Arts for marketing purposes relating to the event.

  • Artist agrees to share Swan Open Studios information to their networks.

  • Artist agrees to use ONLY the Swan Open Studios branding in their own promotion of the event.
